STANDARD TERMS AND CONDITIONS OF SALE

  1. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
  2. Inward Remittance Bank Charges of US $ 35 is applicable for all transactions
  3. All Orders require 100% Advance Payment. Orders shall be confirmed once the remittance amount is in actual confirmed by our Banks
  4. All prices are in US Dollars for all International quotes unless stated otherwise
  5. • Jurisdiction – Mumbai, India
    • Standard validity of quotation is 30 days, unless stated otherwise
    • Orders once placed cannot be canceled without our prior consent in writing
    • If the customer wants Inspection Certificate for bearings from AIBBMA (All India Ball Bearings Merchants Association); Inspection charges 2% of the order value, unless stated otherwise for any special bearings
    • Pricing may be quantity-sensitive, changes to quantity and/or parameters may affect pricing and delivery time & charges
    • Quoted delivery is based on current inventory status and/or material availability; check delivery when placing order and all items are subject to prior sale
    • Items which are quoted without discount are net prices
    • Stenographic and clerical errors are subject to correction
    • All orders are subject to Standard Terms and Conditions of Sale
    • Material ordered should be picked up within 15 days of availability & we would not keep in stock beyond the same; penalty shall be levied
    • Material shall be sent by our choice of transporter & forwarder with their standard lead time of shipment. Any other specific transporter if required; charges shall be borne by customer. All quotes are quoted as Ex-Works and we can quote shipping costs on request.
  6. Our invoices are payable in Advance, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment within the time-frame, Indian Sales reserves the right to cancel the orders without prior warning in the event of late payment.
  7. Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can My Company become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to My Company in its entirety and does not include any costs relating to the legislation of the country in which the client is located.
  8. Indian Sales undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. Indian Sales cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
  9. All our contractual relations will be governed exclusively by India law.
